MEMORANDUM OPINION AND ORDER
Pending is the Motion of Defendant Setzer’s World of Camping to Compel. . Plaintiffs have responded to the motion, , and the time for filing a reply has expired. See L. R. Civ. P. 7.1. For the reasons that follow, the Court GRANTS the Motion to Compel.
First, Plaintiff asserted an objection to all eleven interrogatories on the basis that the requests were “not proportional to the needs of the case.” . This objection was lodged to interrogatories asking for such things as Plaintiff’s name, place of birth, addresses, and social security number an itemization of the expenses he incurred as a result of the incidents giving rise to the complaint the names of his witnesses his employment history, and other standard requests. Clearly, these interrogatories sought information that was relevant and proportional to the needs of the case. Moreover, Plaintiff supplied no explanation for asserting this particular objection, and provided no evidentiary support for the objection.
Third, Plaintiff objected to several interrogatories on the grounds of attorney-client privilege, attorney work product protection, and the privilege that accompanies husband-wife communications. However, he did not properly assert the privileges, because he failed to comply with the requirements of Fed. R. Civ. P. 26. Fed. R. Civ. P. 26 states:

A Subject Matter Jurisdiction Under The Magnuson
To establish subject matter jurisdiction, the Court must find that the Complaint raises an issue “arising under the Constitution, laws, or treaties of the United States.” See28 U.S.C. § 1331. A case may “arise under” federal law when a federal statute creates a cause of action. See Merrill Lynch, Pierce, Fenner & Smith Inc. v. Manning, 136 S. Ct. 1562 . Contrary to Keystone’s contentions otherwise, the Complaint need not rely exclusively on federal law to remain in federal court. If the Complaint raises at least one federal question, the Court may exercise supplemental jurisdiction over state claims “that are so related to claims in the action within such original jurisdiction that they form part of the same case or controversy under Article III of the United States Constitution.” 28 U.S.C. § 1367. Given that the Complaint only alleges federal claims under the MMWA, the validity of those claims will determine whether the Court has subject matter jurisdiction.

Applying West Virginia law, the Court will now consider whether the OMW was validly formed. Based on the factual allegations in the Complaint, the Court has identified two possible theories of formation: that Plaintiffs accepted the OMW when they signed the Sales Contract because it was incorporated by reference, or that Plaintiffs unilaterally accepted the OMW.

This action was referred to the Honorable Cheryl A. Eifert, United States Magistrate Judge, for submission to this Court of proposed findings of fact and recommendation, pursuant to 28 U.S.C. § 636. The Magistrate Judge has submitted her Proposed Findings and Recommendations , and Plaintiffs timely filed their objections . Consistent with this Opinion, the PF& R is REJECTED IN PART and ADOPTED IN PART. The Court DENIES Keystone’s Motion to Dismiss , DENIES Plaintiffs’ Motion to Amend or Remand , and GRANTS Defendant Setzer’s Motion for Partial Dismissal .

HUNTINGTON — The equipment is always changing, but for almost 40 years, Setzer’s World of Camping has been helping Tri-Staters maintain their love affair with the great outdoors and the open road.
Founded in 1969 by Howard Setzer, the business was sold to Lynn Butler’s mother in 1981 and then to Butler in 1995. In 2000, the business relocated to its current location on Cherry Lawn Road, near the intersection of U.S. 60 and Interstate 64.
“We needed more room to grow,” Butler said, “And we liked the higher visibility.”
The dealership carries some of biggest names in recreational vehicles, including Dutchmen, Sunny Brook, Passport, Fuzion, Challenger and Viking. The business also offers tent and truck campers, travel trailers and fifth wheels. They also carry toy haulers, which can either be a trailer or fifth wheel that has an area for a four-wheeler or motorcycle.
Today, buyers are often more interested in the campers and trailers than the all-in-one motorhome, Butler said. That gives campers the freedom to park their living space, rather than driving a large vehicle everywhere they go. But the center’s staff works to help customers find the right fit for their lifestyle.
